Image Licensing & Re-Listing Policy

1. Ownership of Media

WTX Real Estate Photography retains the full Copyright to all images, video, and media produced. The client who pays for the service is granted a limited, non-transferable license to use the media for the purpose of marketing the specific property for the duration of the listing agreement.

2. Termination of License

A license to use the media expires under any of the following conditions:

• The property is sold and closed.

• The listing agreement between the Seller and the Agent is terminated or expires.

• The property is withdrawn from the market.

3. Non-Transferability (The "Third Party" Rule)

Clients may not sell, give away, or "hand off" images to any third party. This includes:

• Transferring photos to a new agent if the listing changes hands.

• Giving photos to the homeowner for their personal/commercial use.

• Sharing photos with builders, stagers, or designers.

Note: These parties must contact WTX Real Estate Photography directly to purchase a separate usage license.

4. Re-Listing License Fees

If a property is withdrawn from the market and later re-listed with a new agent, the new agent may purchase a Re-Listing License for existing media under the following terms:

Existing Media Only: 75% of current rate. This includes a new download link and a fresh license for the new agent’s marketing.

Full Reshoot: If significant changes have been made to the property (painting, renovations, new furniture), a full standard shoot rate will apply.

5. Unauthorized Use

Usage of WTX Real Estate Photography media by an agent who did not purchase a license is a violation of Federal Copyright Law. Unauthorized users will be invoiced for the full Standard Shoot Rate.
